Terms and Conditions for Dawalink

1. Introduction

Welcome to Dawalink, an online marketplace that enables retail pharmacies to order pharmaceutical products at cheap importer prices. By accessing or using our Platform, you agree to comply with and be bound by these Terms and Conditions ("Terms").

Eligibility: User must be a citizen of The United Republic of Tanzania, aged 18 years and above and must provide accurate, up-to-date, verifiable and valid retail Pharmacy licenses provided by pharmacy council, TRA TIN and business license to purchase pharmaceutical products. The Platform reserves the right to suspend or terminate accounts that fail to comply with these requirements.

You are responsible for maintaining the confidentiality of your PIN and for restricting access to your account and agree to accept responsibility for all activities that occur under your account or PIN.


2. Definitions

  • Platform: The online marketplace operated by Dawalink Limited for the sale and purchase of pharmaceutical products.

  • Seller: A licensed pharmaceutical importer or distributor who lists products for sale on the Platform.

  • Buyer: A licensed retailer or pharmacy purchasing products through the Platform.

  • Products: Pharmaceutical goods listed for sale on the Platform.

  • User: Any individual or entity accessing or using the Platform, including Sellers and Buyers.


3. Ordering

  • Orders are placed through the Platform by registered Buyers.

  • Orders placed on the Platform are binding once confirmed by the Importer.

  • By placing an order, the user confirms that all provided information is accurate and complete to prevent errors and delays.

  • The Platform is not responsible for order fulfillment issues arising from inaccurate user information.

  • Order Modifications: Changes to orders can only be made at pending status before the order processing begins.


4. Cancellations

Users may cancel orders before they are processed, when at pending status. Sellers reserve the right to cancel an order due to stock unavailability, pricing errors, or other valid reasons. Buyers will be notified.


5. Return and Exchange

  • Returns and exchanges are only accepted for damaged, defective, or incorrectly shipped products and requests must be submitted within 24hrs of delivery.

  • Users must notify the Dawalink support team of any issues with received Products within 24hrs of delivery to initiate a return or exchange on behalf of the importers.

  • Return delivery costs may apply unless the error is attributable to the Seller or platform.

  • Refunds will be processed within 24 hrs after the returned product is received and inspected only if the sellers cannot supply the intended product.


6. Pricing and Delivery

  • All prices are set by the Seller and are subject to change without prior notice.

  • Prices exclude taxes, shipping fees, and customs duties, which will be calculated at checkout.

  • Delivery times are estimates and may vary based on location and delivery method.

6.1 Delivery Person

  • Delivery Responsibility: They are responsible for delivering the ordered product(s) to your specified destination.

  • Checklist and Verification: They will provide a checklist of the purchased products for your review. By signing the checklist, you confirm receipt and acceptance of the products.

  • Payment completion: They are responsible for ensuring payments are completed upon delivery of the products.


7. Bill Pay

  • Order payments are made on the delivery of the ordered products.

  • Payments can be made using approved methods to the Dawalink Lipa number or Dawalink Bank on behalf of the sellers.

  • The buyer receives a token to approve the payments continuation.

  • Late payments may result in order cancellations, additional fees, or suspension of account privileges.


8. App Accessibility

We aim to keep the app accessible but may suspend or terminate access at any time without notice. By using the app, you accept that interruptions may occur due to maintenance, updates, or unforeseen circumstances.


9. Amendments

The Platform reserves the right to modify these Terms at any time. Users will be notified of changes, and continued use of the Platform constitutes acceptance of the revised Terms.


10. Governing Law and Dispute Resolution

These Terms and Conditions shall be interpreted and governed by the laws in force in the United Republic of Tanzania.


11. Trademark and Copyright

All content on the Platform, including logos, trademarks, and software, is the sole property of Dawalink Limited and is protected by intellectual property laws.


12. Termination and Suspension

The Platform reserves the right to suspend or terminate accounts violating these Terms. Users may close their accounts at any time, provided all pending transactions and obligations are settled.
